Herond Labs Corporation ("we", "us", or "our") is committed to protecting the personal information of individuals who use Herond Browser ("Herond" or "Browser"). This Privacy Policy explains how we collect, use, share, and secure information obtained through your use of Herond. For the purposes of this Policy, "you" or "user" refers to individuals who use Herond and its associated services.

This Privacy Policy forms part of, and should be read together with, the Herond Browser Terms of Use. Where there is any inconsistency between this Privacy Policy and the Terms of Use on matters of data protection, this Privacy Policy will prevail.

I. DATA ACCESS & USAGE

We collect only the information necessary to provide our services. By clicking "Agree", accessing our platform, and/or using Herond's services, you acknowledge and agree that you have read, understood, and consented to:

(a) provide all required data to Herond; and

(b) grant us and Herond permission to collect, store, use, and share your data as described in this Privacy Policy, including any future updates or modifications.

We may also process certain data as necessary to perform our contract with you (to provide the Browser and related services), to comply with legal obligations, or based on our legitimate interests in securing and improving the Service.

  1. Data Control & Transfer

Herond Browser is a product of Herond Labs Corporation, a legally registered company operating in compliance with applicable laws. Herond Labs Corporation is responsible for determining how and why data collected through Herond Browser is processed.

To support product development and business operations, Herond may integrate with certain third-party infrastructure providers (“Third-Party Services”) to enable certain Web3, blockchain, and fiat functionalities. Such integrations may include, but are not limited to:

• Key Security Service;

• Transaction Services;

• Fiat On-ramp Providers;

• Data and Display Providers.

When you use the Herond Browser to access Third-Party Services, certain limited technical or transactional data may be required to be transmitted. Herond does not sell, store, collect, or process any personally identifiable information (PII) or private key data unless explicitly provided by you through those external services, or otherwise described in this Privacy Policy.

However, we may collect limited account or service data that you provide to us directly (for example, your email address when creating a Herond Account, or data you choose to sync) in order to operate the Service.

All such data exchanges are encrypted in transit and processed only to enable the requested functionality. Herond implements a strict data minimization policy and complies with applicable data protection regulations.

Use of Third-Party Services is further subject to each provider’s privacy notice and data-handling practices, which Herond does not control or audit.

Such sharing is always conducted in compliance with applicable laws and relevant contractual agreements to ensure the highest level of data privacy for users. In the event that we are required by law or by a government authority to disclose information, Herond will cooperate fully to comply with our legal obligations.

Herond makes no warranty or representation regarding the performance, accuracy, or availability of any Third-Party Service, nor does it warrant the outcome of transactions, key operations, or data obtained through such services.

  1. Location

Herond may request your permission to collect and provide geolocation data if a website you visit asks for this information. You will be prompted to consent to sharing your location. If you consent, Herond will provide the website with an approximate location based on your IP address. Herond does not retain your IP address for longer than necessary to deliver the requested functionality and maintain security; however, the website you visit or third-party security services may log your IP address.

  1. Synchronization

Herond Browser offers a secure synchronization feature (Sync) that allows users to store and synchronize their bookmarks, passwords, extensions, personalized settings, and other browser-related data across multiple devices. This data is encrypted and stored on our cloud servers. The decryption key is exclusively held by the user, ensuring complete privacy from Herond Labs Corporation. To use the Sync feature, users must create a Herond Account.

  1. Herond Account

To create a Herond Account, we will need to collect your email address. This information is essential for providing our services and enabling you to manage your Herond experience. Your email address will be used for important communications, such as password recovery, service registration, and confirmation. We may also use it to send you news, promotions, and information about Herond-related events. If you wish to delete your Herond Account, please send an email request to contact@herond.org using the registered email address associated with your account. Within fourteen (14) days of receiving your request, we will process it and assist you in deleting your account, personal data, associated features and services settings, information, access to documents and applications, synchronized data, and linked third-party accounts. Please note that account deletion is irreversible, and your data may be permanently lost. Before deleting your account, ensure that you have backed up any important or necessary information.

  1. Herond Wallet

Herond Wallet is a secure digital asset management tool integrated into the Herond Browser. It enables users to buy, send, store, and exchange a wide range of digital assets, including non-fungible tokens (NFTs), across more than 100 blockchain networks such as Ethereum, Solana, and Filecoin. Herond Wallet is a non-custodial wallet. This means Herond does not at any time receive, store, or have access to your private keys, seed phrases, hardware wallet credentials, or any other means of authorizing blockchain transactions. 

You are solely responsible for safeguarding your credentials (eg. private keys and digital assets) and for all transactions executed using them and backing up private keys.

Herond cannot recover or reset your private keys, seed phrases, hardware wallet credentials and shall not be liable for any loss, compromise, unavailability, or misuse of your credentials, or for any unauthorized transactions conducted through or in connection with the Service.

Herond places a high priority on user privacy and does not track any activities within your digital wallet:

To safeguard your privacy, Herond masks your IP address when you access the Herond Wallet. However, please be aware that when conducting transactions through third-party services (such as on-ramp provider) that require redirection, those services may collect your IP address and conduct identity verification checks as mandated by anti-money laundering and sanctions regulations. We recommend reviewing the privacy policies and terms of service of these third-party providers.

Herond utilizes Decentralized Exchange Aggregators (DEXs) like 0x for Ethereum Virtual Machine (EVM) compatible blockchains and Jupiter for Solana blockchain swaps. These DEXs will process your wallet address, transaction data, and IP address solely to facilitate the transaction, including obtaining price quotes.

We utilize TransFi to offer cryptocurrency on/off ramp services. Herond Labs Corporation does not directly handle these transactions. All personal information provided by the user to TransFi for the purpose of facilitating such transactions (including but not limited to: credit card or debit card information, transaction history, digital wallet details, and other financial information) is collected, used, and secured by TransFi in accordance with TransFi's privacy policy and applicable data protection laws.

Herond does not collect, use or process any payment credentials and is not be liable for any delay, reversal, dispute, or loss arising from such fiat-based transactions.

Herond will not and will never: 

(a) store or back up your private key; 

(b) have access to your recovery phrase; 

(c) sign or execute any transaction on your behalf; or (d) hold custody of any user funds. Herond Wallet is designed to give you full self-custody and operational independence.

  1. Cookies and Similar Technologies

Herond uses cookies and similar technologies to provide the basic functionality of the websites you visit and enhance your user experience. The usage is strictly for operational purposes and is not intended to involve the collection or processing of any personally identifiable information.

You can control how websites use cookies by adjusting Herond Browser settings:

  1. Access to Device Features

With your consent, Herond may access and utilize certain device features, including but not limited to the microphone and/or camera, as required by specific websites or extensions you have interacted with. You may revoke this permission at any time through your device's settings or the settings of the relevant website or extension. Please note that while Herond itself does not collect any information through this process, the website or extension requesting access may do so independently.

II.SECURITY & UPDATES

Herond automatically checks for updates to ensure users always have access to the latest security fixes. We track the number and type of these requests to produce aggregate statistics that help us improve our product, which does not contain identifiable information.

Safe Browsing

To help protect users from encountering unsafe websites, downloads, and extensions, Herond utilizes Google Safe Browsing. This service maintains constantly updated lists of unsafe web resources to identify threats such as fraudulent sites and malware distributors.

Desktop:

  • Herond leverages the Safe Browsing Update API, which involves storing a local copy of unsafe website addresses (hashed for anonymity) on your device.

  • When browsing, Herond acts as an intermediary, sending these hashed addresses to Google's servers. This minimizes the information Google receives (excluding your IP address) and safeguards against potential user profiling.

iOS:

  • Apple serves as the intermediary for Google Safe Browsing on iOS devices, proxying through their own server.

  • If you're an iOS user in mainland China, Tencent Safe Browsing might also be employed. You can find more details on Apple's privacy policy here: https://www.apple.com/legal/privacy/data/en/safari/

Android:

  • Herond integrates with the SafetyNet Safe Browsing API provided by Google. When your device identifies a potentially harmful URL based on its local list, a portion of the hashed address is sent directly to Google. This approach mirrors the functionality of the Safe Browsing Update API on desktops.

III. TO IMPROVE HEROND BROWSER
  1. Diagnostic reports

In the event Herond encounters an unexpected issue, such as a crash or freeze, it generates a report that can be sent to us to help diagnose and resolve the issue. This report contains technical information about your computer system and the event causing the problem. The data cannot be used to identify you.

You can choose whether to send them to us in your settings:

  • Go to Settings > Privacy & Security > Personalization

  • Look for the option Help improve Herond's features and performance

  1. Product Analytics

To enhance Herond's performance and user experience, the browser will periodically send us anonymous, aggregated data about its usage. It consists of general usage information about the Browser and other Herond products, such as approximate numbers of installed extensions and open tabs, and the status of features like Shields and Wallet. This data is stripped of any identifying information and combined with data from other Herond users.

Users can deactivate Privacy-Preserving Product Analytics in Settings:

  • Go to Settings > Privacy & Security > Personalization

  • Look for the option Allow privacy-preserving product analytics (P3A)

  1. Your feedback

Any feedback you provide to Herond is greatly appreciated and helps us enhance our product. You can voluntarily share specific details about issues or concerns you encounter while using Herond Browser.

We do not collect or store any personally identifiable information. Any PII inadvertently included in your feedback will be removed before it is used. The data you provide is exclusively used to improve our services, enhance your browsing experience, and address potential or outstanding issues.

  1. Children's Privacy

We do not collect personal information from children under 13 years old without parental or guardian consent. We always require parents or guardians of children to confirm consent before collecting, storing, using, or sharing any personal information of children. Third parties affiliated with and cooperating with us in providing services to your family are also required to comply with children’s privacy protection regulations by not collecting personal information from children according to this policy.

If you believe that a child under 13 in your family has provided personal information without your consent, please contact us using the contact information provided in the Contact Us section. We encourage parents to guide their children’s online activities and review this privacy statement.

We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. The updated policy will be available on our website. We encourage you to periodically review this Privacy Policy to stay informed about our practices. We hope you’ll find our policies agreeable, but if you’re not comfortable with the types of data we collect or how we use it, we understand your choice to stop using Herond Browser.

Your continued use of the Service after any update to this Privacy Policy will constitute your acknowledgment of the changes and your consent to the updated Policy.

V. DATA RETENTION

We retain personal data for no longer than is necessary for the purposes for which it is processed, including for the purpose of satisfying any legal, regulatory, accounting, or reporting requirements. Synced browser data is retained for as long as you maintain your Herond Account or until you delete it.

VI. OVERSEA DATA TRANSFERS

Because we work with global infrastructure and Third-Party Providers, your information may be transferred to and processed in countries other than your country of residence. In such cases, we will take appropriate safeguards to ensure that your personal data remains protected.
